Judge Allows Ex-Doctor's Comments Statements Came Before Arrest in Fatal Crash

Any statements made by former physician Mark M. Benson before he was arrested in a crash that killed an Oconomowoc educator, her unborn child and her 10-year-old daughter will be allowed in court, a Waukesha County judge ruled Thursday.

Circuit Judge J. Mac Davis agreed with the state that Benson was repeatedly told immediately after the crash that he wasn't under arrest and is an educated man who should have understood that any statements he made could be used against him.
