Madison On the day it was revealed that Democratic Gov. Jim Doyle's campaign lobbied Democrats on the State Elections Board to punish challenger Mark Green, the Republican's campaign on Thursday asked a Dane County judge to set aside the board's order that he give up $467,844 from out-of-state political action committees.

"Mark Green's hands were clean" when he transferred $1.3 million including the $467,844 from his congressional campaign account to his state campaign fund in January 2005 to start his run for governor, Green lawyer Dan Kelly told a Dane County judge.

For the first time, state Justice Department attorneys said Green's transfer of the entire $1.3 million broke state and federal laws, and the Elections Board legally ordered Green to give up the $467,844.

Kelly said that when Green's campaign transferred the $1.3 million, it relied on past Elections Board decisions that allowed three similar transfers since 1977.
