Madison Convicted child molester Shawn D. Schulpius should be discharged from a mental facility, despite a psychologist's finding that he remains dangerous, because Milwaukee County and the state Department of Health and Family Services have failed to provide adequate housing for his supervised release as required by state law, his attorney told the state Supreme Court on Thursday.

Ellen Henak, an assistant public defender, argued that that failure violates Schulpius' constitutional rights. She suggested that releasing him may be the only way to force compliance with the state law, Chapter 980, that requires some sexually violent offenders to be returned under supervised release to their county of origin.
