A federal appeals court Monday dismissed a lawsuit aimed at forcing the Bush administration to release documents related to a task force headed by Vice President Dick Cheney, which met four years ago to put together a national energy policy. Given the nature of the suit and the law governing the structure of the task force, the court may have had no other option. But this is no victory for democracy.
Fortunately for citizens, another lawsuit based on freedom of information laws is still pending in the courts and "remains very much alive," according to the Natural Resources Defense Council, which brought the suit.
